Terms of Use and User Agreement

 

Welcome to T-Short!

T-Short is a thematic platform which provides technologies and services that allow users to create personal pages, present short animated films to the public, communicate with each other, and create communities and workshops. This User Agreement governs your use of T-Short as well as other products, features, applications, services, technologies, and software that we offer or will offer, unless explicitly stated that specific terms are applied but this agreement does not apply to users. 

We do not charge you for T-Short products and services described in this Agreement. Instead, businesses and organisations pay us to advertise their products and services. By using our Products, you agree that we can show you advertisements that we think will be relevant to your interests. We use your personal data to help determine which advertisements to show you.

We do not sell your personal information to advertisers and we do not provide them with information that identifies you (such as your name, email address or other contact information) unless you give us specific permission. However, advertisers can tell us the target audience for their ads, and we will show those ads to people who may be interested. We provide advertisers with ad performance reports that help them understand how people are interacting with their content. For more information, see section 2 below.

Our Data Policy explains how we collect and use your personal information in order to determine the ads that may be relevant to you and provide other services described below. At any time, you can change your privacy level about how we use your data in the Settings.

1. The services we provide

The mission of T-Short is to help professionals and fans of animated films around the world come together in one big community. To help advance this mission, we provide you with the Services described below:

T-Short platform helps you personalize your activities.
Your activity is unique: from the workshops, posts, stories, events, ads and other content that you see in the News Feed or the movies and channels you watch on our video platform, to the Pages that you follow and other features that you may use now and that will be offered as we develop the resource. We use the data that we have, for example, about the connections you make, the choices and settings you make, the content you share, and your activities on and off our Products, in order to personalize your experience with the T-Short Platform.

We connect you with people and organizations that may interest you.
We help you find and connect with people, groups, businesses and organizations that are relevant to you by using the T-Short products. We use the data that we have to provide recommendations to you and others – for example, groups to join, events to attend, Pages to follow or send a message to, movie to watch, channels to subscribe to, and people who you may want to become friends with. The stronger ties, the better the community. We believe that our services are most useful when people are connected to people, groups and organizations that interest them.

We give you the opportunity to express yourself and communicate on topics that are important to you.
There are many ways to express yourself and communicate on topics that are important to you: for example, sharing sketches of finished and unfinished films, sharing photos or videos from festivals, stories, creating events or groups, organizing workshops and engaging people, or simply adding content to your profile.

We give you the opportunity to search for content, products, and services that may interest you.
We show you ads, offers, and other advertising content to help you discover content, products, and services that are offered by businesses and organizations that use the T-Short platform. You can learn more in section 2 below.

We combat harmful behavior, protect and support our community.
People will support the T-Short community only if they feel safe. If we become aware of any content or behavior that violates the peace and safety of T-Short users, we will take appropriate action, including removing content, banning or disabling the offender's account, and, if necessary, contacting law enforcement. If abuse or dangerous behavior is detected when using the T-Short platform, we will promptly take appropriate action.

We research ways to improve the quality of our services.
We invest in research in order to develop, test and improve our system. This includes analyzing the data we have about our users and understanding how people use our system, for example by conducting surveys, testing and troubleshooting new features. Our Data Policy describes how we use data for research to develop and improve our services.

 

2. How our services are funded

Free Account:

You do not pay to use the T-Short platform or the services we offer, but by using the T-Short features covered by these Terms, you agree that we can show you ads for which businesses and organizations pay us to promote their products and services on and off the T-Short platform.
We ensure the personal data privacy. This is very important for our ads system. This means that we can show you ads that are relevant to you, without telling the advertiser who you are. We do not sell your personal information. We allow advertisers to tell us their target audience to whom they want to show their ads. We then show their ad to people who might be interested.
We also provide advertisers with ad performance reports that help them understand how people are interacting with their content on T-Short. We do not share any information that identifies you (such as your name and email address that can be used to contact you or identifies you) unless you give us specific permission.

We collect and use your personal data to provide you with the services described above. You can learn more about how we collect and use your data in our Privacy Policy.

In addition, we receive income from the sale of tickets to the festival (Festival Pass) and other competitions, and we also offer users paid accounts, such as a PRO account and Ad-free account.

Festival Pass:

In order to access all of the festival films, user must to purchase a Festival pass.

The possibility to vote for films appears after purchasing Festival pass too.

Festival pass can be purchased on the dates of the festival.

Festival pass are valid for 2 weeks from the date of purchase.

Festival pass price is €10 for 2 weeks.

Festival pass are non-refundable.

 

3. Your commitments to T-Short and our community

We provide you and others users with these services to make you feel comfortable on the T-Short website. In exchange, we need you to make the following commitments:


1. Who can use T-Short platform

When we are aware that real people are behind their opinions and actions, it helps us create a safer and more responsible community. For this reason, you must:

• use the same name that you use in everyday life or the name of the studio or school you present;
• provide accurate information about yourself;
• create only one account (your own) and use your timeline for personal purposes;
• not share your password, give access to your T-Short account to others or transfer your account to anyone else (without our permission).

We try to make T-Short available to everyone, but you are not allowed to use it if:

• You are under 13 years old.
• You are a convicted sex offender.
• We've previously disabled your account for violations of our Terms of Use.
• You are prohibited from receiving our products, services or software in accordance with applicable laws.


2. Permitted actions with films in the Film Gallery and Festival sections

A. Films uploaded to the Film Gallery and Festival sections must meet the following criteria:

a) an animated short film with a running time of 25 minutes or less (± 5 minutes);

b) the film must be finished and have a title and credits, except for music videos;

c) all films must be either in English or have embedded English subtitles;

d) uploaded films must be accompanied by as much information as possible;

e) the same film cannot be presented more than once, by different persons or under different titles;

f) you can post only those films for which you have copyright;

g) the content of the films must not violate subparagraph 3 of paragraph 3 of this Terms of Use.

Attention!

The video format must comply with these recommendations, other formats are not supported!

The T-Short administration has the right to remove unwanted and inappropriate videos without warning.


3. Allowed content, permitted and prohibited activities on the T-Short Platform

We want people to use T-Short to express themselves and share content that is important to them, but without violating the safety and well-being of others or the intellectual rights and ethics of our community. You therefore agree not to engage in the activities described below (or to facilitate or support others in doing so):

You may not use our Resource to share content or do any of the following:

Register as a User on behalf of or instead of another person (create a "fake account") or register a group (association) of persons or a legal entity as a User. At the same time, it is possible to register for and on behalf of another individual or legal entity, subject to obtaining the necessary authority;

Mislead Users by using the login and password of another registered User;

Misrepresent yourself, your age, or your relationships with other people or organizations;

Upload, store, post, share and make available or otherwise use any information that:

a) contains threatening, calling for violence, including hidden calls, approval and encouraging of violent actions, discredits, insults, defames honor and dignity or business reputation, or violates the privacy of other Users and third parties

b) violates the rights of underage persons

c) is vulgar or obscene, contains pornographic images and texts or scenes of a sexual nature with participation of underage persons;

d) contains scenes of cruel treatment of animals;

e) contains a description of the means and methods of suicide, any incitement to commit it;

f) promotes and/or encourages racial, religious, ethnic hatred or enmity on the grounds of gender, orientation, and other individual characteristics and qualities of the person (including health issues);

h) contains extremist materials;

i) promotes criminal activity or contains advice, instructions, or guidance on how to commit criminal acts;

j) contains restricted information, including, but not limited to, state and trade secrets, information about the private life of third parties;

k) contains ads or outlines the appeal of using drugs, including "digital drugs" (sound files that affect the human brain through binaural rhythms), information about drug distribution, recipes for making drugs, and recommendations for use;

l) can potentially lead to the commission of a crime by misleading or abusing the User's trust;

m) as well as violates other rights and interests of individuals and legal entities.

You are not allowed to:

Illegally upload, store, post, share, distribute and provide access to or otherwise use the intellectual property of Users and third parties.

Send mass messages to other Users of the Site without their consent.

Use the software and perform actions aimed at disrupting the normal operation of the Site or personal pages of Users.

Upload, store, post, share and provide access to or otherwise use viruses, trojans, and other malicious software.

Use automated scripts (programs, bots) to collect information on the Site and/or interact with the Site and its features without special permission of the Site Administration.

Try to gain access to another User's login and password by any means, including, but not limited to, deception, breach of trust, hacking.

To conduct unlawful collection and processing of personal data of other users.

Use the Site in any other way than through the interface provided by the Site Administration, unless such actions are explicitly allowed to the User under a separate agreement with the Administration.

Produce, duplicate, copy, sell, carry out trade operations or resell rights to use the Site, including its non-activated data and commands, for any purpose unless such actions are explicitly permitted to the User under the terms of this Policy or a separate agreement with the Administration.

Post commercial and political advertising outside the special sections of the Site, established by the Site Administration.

Post any other information, considered by the Administration to be undesirable, that does not correspond to the purposes of the Site, infringe the interests of Users, or for other reasons is inappropriate for posting on the Site.

Carry out mass single-type actions aimed at artificial increase in indicators of Site counters (number of friends, "Like" marks, "Tell your friends" events, etc.) on your own or on behalf of other Users, by using the functionality of their accounts, including through the misleading or the promise of encouragement, which includes the use of any programs, automated scripts.

We may remove or ban content that violates these provisions without explanation.

We encourage you to complain about content and behavior that you think violates your rights, including intellectual property rights, or our terms and policies. By doing so, you will help support and improve the community.

We may also deny or restrict access to your content, service or information if we determine that it is reasonably necessary to prevent or reduce the negative legal or regulatory impact on T-Short.


4. The permissions you give us

We need certain permissions from you to provide our services:

1. Permission to use content that you create and share. You own the content that you create and share on T-Short and nothing in this User Agreement denies your rights to your own content. You are free to share your content with anyone else, wherever you want. However, in order to provide our services, we need you to give us certain legal permissions to use such content.

Specifically, when you post or upload content that is subject to intellectual property rights (such as photos or videos) through our network or share such content, you grant us a non-exclusive, worldwide, transferable, sublicenseable license to store, use, distribute, modify, run, copy, perform or display in public, translate, and create derivative works based on your content (in accordance with your privacy settings). This license is given exclusively for the purpose of providing you with our Products. This means, for example, that if you share a video or photo on T-Short, you give us permission to store, copy and share it with others (again, in accordance with your settings), for example, with service providers who support our services or other features you use.
You can terminate this license at any time by deleting your content or account. You should be aware that, for technical reasons, content that you have deleted may be backed up for a while (without being visible to other users). In addition, content you have deleted may be visible if you have shared it with others and they have not deleted it.

2. Permission to use your name, profile picture and information about your actions with ads and sponsored content: Your name, profile picture and information about your actions on T-Short may be used alongside or in connection with advertisements, offers or other sponsored content that we display on our Network without paying you any fee. For example, we may show your friends that you are interested in an advertised event or have "Liked" a Page created by a brand that has paid us to show its ads. Only people who have your permission to see your activities on T-Short can see ads like these.

3. Permission to update software that you use or download. If you download or use our software, you give us permission to download and install updates to the software, where available.

5. Limits on using our intellectual property

If you use content that is subject to intellectual property rights that we have and make available in our Products (for example, when you create or share content on T-Short, you may add images, designs, videos or sounds that we provide), we retain all rights to that content (but not to your content). You may use our copyrights and trademarks (or any similar marks) only as permitted by (and only in accordance with) our Brand Usage Guidelines or with our prior written permission. You must obtain our written permission (or permission under an open source license) to modify, create derivative works, decompile, or otherwise attempt to get the source code from us.

 

4. Additional terms


1. Updating our Terms


We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update this User Agreement from time to time in order to accurately reflect our services and practices. We will only make changes if the provisions are no longer appropriate or if they are incomplete, and only if the changes are reasonable to you in your best interests.
We will notify you (for example, by email or through our Products) at least 30 days before we make changes to this User Agreement and give you an opportunity to review such changes before they go into effect, unless changes are required by law. We will notify you of this 30-day period and its importance. If you continue to use our Products after the updated User Agreement goes into effect, you will be bound by the updated User Agreement.
We hope that you will continue using our Products, but if you do not agree with our updated User Agreement and no longer wish to be a part of the T-Short community, you may delete your account at any time.


2. Account suspension or termination

We want you to feel at home, feel safe to express yourself and share your thoughts and ideas.
We have a right to terminate the agreement for good cause. In particular, good cause is considered when a party violates their obligations covered by these Terms, any laws, third party rights or privacy policies and, considering all the circumstances of the particular case and taking into account the interests of both parties, the terminating party would not be expected to maintain the contractual relationship until the agreed date of termination or the expiration of the notice period. Termination for good cause is possible only within a reasonable time after the party becomes aware of the violation.
If a good cause is a violation of obligations under these Terms, termination is only possible after the expiration of the period granted to eliminate the violation or after a warning if the violation has not been eliminated. However, postponement of the application of the legal remedy may not apply if the other party seriously and permanently refuses to fulfill its obligations or an immediate termination is justified in the circumstances, taking into account the interests of both parties.
If you delete or we disable your account, this User Agreement is terminated as an agreement between you and us.

3. Limitation of liability

We are liable in accordance with the legal provisions only in the following cases: in case of any harm done to life or health, in case of intent or gross negligence or in accordance with the Product Liability Act.
Without limiting the foregoing, we are liable for a minor omission only if we violate an essential obligation under this agreement. Essential obligations in this sense are obligations that are necessary for the performance of the agreement, whose violation would jeopardize the achievement of the purpose of the respective agreement on which you can rely. In these cases, liability is limited to typical and foreseeable losses; in all other cases, we are not liable for minor omissions.


4. Disputes

We try to provide clear rules in order to limit or avoid disputes between you and us. However, if a dispute does arise, it is useful to know in advance, where it can be resolved and what laws will apply to it.
If you are a consumer and you have a permanent residence in any Member State of the European Union, any requirements, claims and disputes between you and us arising out of or in connection with this User Agreement or the T-Short Products ("dispute") shall be governed by the laws of that Member State and you may resolve the dispute in any competent court that has jurisdiction over the dispute in that Member State. In all other cases, you agree that the dispute shall be resolved in a competent court in Germany and that this User Agreement and any dispute shall be governed by the laws of Germany without regard to its conflict of law provisions.

5. Other

1. This User Agreement (formerly known as the Statement of Rights and Responsibilities) constitutes the entire agreement between you and T-Short with respect to your use of our Services. This agreement supersedes all prior agreements.

2. If you post or share content that contains music, you must comply with our Music Guidelines (see below). If there is a conflict between any additional terms and this User Agreement, the additional terms shall govern to the extent of the conflict.

3. If any part of this User Agreement is considered unenforceable, the remaining provisions continue to be in full force and effect. If we fail to enforce any provision of this User Agreement, it will not be considered a waiver. Any amendment or waiver of this User Agreement must be in writing and signed by us.

4. You will not transfer your rights or obligations under this User Agreement to anyone else without our consent.

5. You have the right to designate a person (called a legacy contact) to manage your account if it gets a memorial status. Only your legacy contact or a person you designate in a valid will or similar document expressing clear consent to disclose your content in case of your death or incapacity has the right to obtain disclosure of your account information after memorial status has been established.

6. This User Agreement does not grant any rights to any third party beneficiaries. All of our rights and obligations under this User Agreement are freely assignable by us in connection with a merger, acquisition or sale of assets, by operation of law or otherwise.

7. You should be aware that under certain circumstances we may need to change your account username (for example, if someone else claims this username and it does not appear to be related to the name you use in your everyday life). If we need to do this, we will inform you in advance and explain why this is necessary.

8. Your feedback and other suggestions about our products and services are important to us. However, you should know that we may use them without any restrictions, and we have no obligation to keep them confidential.

 

5. Other Terms and Policies that may apply to you


Advertising Policies:
These policies specify the types of advertising content that partners who advertise on T-Short are allowed to use. When an advertiser places an order, each advertisement is reviewed for compliance with these rules. Before ads appear on T-Short, they are reviewed for compliance by our Editorial Team. Typically, most ads are reviewed within 24 hours, but in some cases it may take longer.
We check your advertisements' images, text, targeting and positioning, as well as the content of the landing page. Your ads may not be approved if the landing page content does not function properly, does not match the products or services promoted in the advertisement, or violates our Advertising Policies.
If your ad has not been approved due to complying with our policies, you can edit it and resubmit it for review.


Prohibited advertisement

Advertisements must not violate our Community Standards.

Advertisements must not contain, promote or facilitate illegal activities, services or products. Ads targeted to minors must not promote products, services or materials that are inappropriate, illegal, dangerous or that mislead or exert undue pressure on the target age groups.

Advertisements must not discriminate or encourage discrimination against people based on personal characteristics such as race, ethnic origin, color, nationality, religion, age, gender, sexual orientation, gender identity, family status, disability, medical condition or genetic disorder.

Advertisements must not promote the sale or use of tobacco products or tobacco paraphernalia. Advertisements must not promote electronic cigarettes, vaporizers or other products that simulate smoking.

Advertisements must not promote the sale or use of illegal, light drugs or prescription medicines.

Advertisements must not promote the sale or use of any nutritional supplements.

Advertisements must not promote the sale or use of adult products or services.

The exception is family planning and contraceptive advertising. Advertisements for contraceptives must promote the contraceptive qualities of the product, but not sexual pleasure or sexual enhancement, and must be displayed to people aged 18 years or older.

Advertisements must not contain adult content. This includes images of naked body parts, people in explicit or suggestive positions, and activities that are overly suggestive or sexually provocative.

Advertisements that represent or imply the ability to meet someone, connect with someone or view content must not be positioned in a sexual way or with an intent to sexualise the person featured in the ad.

Advertisements must not contain advertising that infringes the rights of any third parties, including copyrights, trademark rights, privacy, publicity and other personal rights, and property rights.

Advertisements must not contain shocking, provocative, sensational or violent content.

Advertisements must not contain material that refers to or implies personal characteristics. This includes direct or indirect reference or implications to race, ethnic origin, religion, beliefs, age, sexual orientation or behavior, gender identity, disability, medical condition (including physical or mental health), financial status, union membership, voting status, criminal record or name.

It is prohibited to publish advertisements that contain statements debunked by outside fact-checkers or - in some cases - by organizations with expertise in the field. Advertisers who repeatedly publish false information are likely to lose the opportunity to advertise.

Advertisements must not direct people to non-functional landing pages. This category also includes pages that that interferes with a person's ability to navigate away from the page.

Advertisements must not promote goods or services that encourage fraud or deception.

Advertisements must not contain profanity or grammatical or punctuation errors. Symbols, numbers and letters must be used appropriately without attempting to mislead us or other control systems during ad review process.

It is forbidden to show images of non-existent features in advertisements. This includes images of play buttons, notifications, checkboxes, multiple-choice options that cannot actually be clicked, etc.

Advertisements should not contain "before" and "after" images or images that show unexpected or improbable results. Advertisements must not imply or generate a negative image of anyone in order to promote weight loss products, dietary supplements, or other wellness products.

Advertisements must not promote microloans, credits and loans against future wages or other short-term loans to cover one's expenses until one's next payday. Short-term loans refers to loans of 90 days or less.

Advertisements that promote income opportunities must describe the product or business model in detail and must not promote models that offer quick profits with little investment, including network marketing models.

Advertising cannot promote Scandinavian auctions, pay-per-bid auctions or other similar business models.

Advertisements must not link to external landing pages with inappropriate or annoying content. This includes misleading ad positioning, such as sensational headlines or ads attracting people to landing pages that contain little original content and lots of unrelated and low-quality ads.

Advertisements must not contain spyware, malware or any other software that can cause unexpected consequences or deceive users. This category also includes links to sites containing these products.

Advertisements must not contain audio or flash animation that plays automatically without user interaction or that is displayed within T-Short after clicking on the advertisement.

Advertisements must not promote goods, services, schemes or offers for the purpose of users misleading, in particular to obtain money or personal information by fraud.

Advertisements must not contain tactics that are intended to circumvent our advertisement review process or compliance systems. Techniques designed to disguise ad's content or landing page are also prohibited.

Advertisements must not promote financial products and services that are commonly associated with fraudulent schemes.

Ads must not advertise the sale of human body parts or biological fluids;
cosmetic procedures and weight loss products and services;
alcohol and drug treatment.

Advertisements must not be related to public issues, elections or politics.


Advertising restrictions

Alcohol

Ads that promotes or mentions alcohol must be in accordance with all applicable local laws, required or established industry standards, regulations, licenses and permissions. Targeting must be aimed at audiences that meet T-Short's age and regional criteria for targeting and in accordance with local laws. Please note that ads that promote or mention alcohol are prohibited in some countries, including the following: Afghanistan, Bangladesh, Brunei, Egypt, the Gambia, Kuwait, Libya, Lithuania, Norway, Pakistan, Russia, Saudi Arabia, Turkey, the United Arab Emirates and Yemen.

Gambling and other online games

Some types of ads can be displayed only with our prior written permission. This applies to gambling and other online games that require you to provide something of monetary value (cash, digital or virtual currencies such as bitcoin) in order to be allowed to play and receive a prize in monetary terms. This also includes games which require you to make a purchase in order to continue gameplay and/or receive a more valuable prize in monetary terms. Advertisers authorized to display ads must follow all applicable laws and legal requirements, including not targeting ads to anyone under the age of 18.

Online pharmacies

Advertisements must not promote the sale of prescription pharmaceuticals. Advertising of online and traditional pharmacies is only permitted with our prior written permission.

Promotion of over-the-counter medicines

Advertisements of over-the-counter medicines must comply with all applicable local laws, industry standards, regulations, licenses and approvals. Age and country targeting must also comply with applicable local laws.

Subscription services

Advertisements for subscription services or products and services that include negative options, automatic renewal, payment system of products or mobile marketing must comply with our requirements.

Financial and insurance products and services

The landing page of advertisements that promote credit cards or financial services of accredited institutions must sufficiently reveal information regarding fees, including the annual interest rate, transaction fees, loan rates and the physical address of the organization offering the product. Advertisements promoting credit cards, loans, or insurance services must be targeted to people 18 years of age or older. Advertisements promoting credit card and insurance services must not directly request anyone's financial information, including credit card information.

Branded content

Advertisements that promote branded content should mark all mentioned third-party products, brands and business partners by using branded content tool. Branded content in advertising is the content of an author or publisher that represents a business partner or is created with that partner on a reimbursable basis. Advertisers should promote branded content integration using a branded content tool (read more about how to mark promoted third-party products, brands or business partners here).

Cryptocurrency products and services

Advertisements must not promote cryptocurrency products or services without our prior written permission.

Advertisers are responsible for understanding and complying with all applicable regulations and laws. Non-compliance may result in a variety of consequences, including cancellation of your advertisements and account termination.

We reserve the right, in our sole discretion, to reject, approve or remove advertisements for any reason, including advertisements that have negatively impact on our relationships with people or which promote content, services or activities that conflict with our interests, principles or advertising philosophy.

Before you submit a restricted ad content, please send a request to the site's administration at this address support @ t-short.net.

Self-Serve Advertising Terms: These terms apply if you use self-service advertising interfaces for creation, submission or presentation of advertisements, or other commercial or sponsored activities or content.

The following terms ("Self-Serve Advertising Terms") apply to your use of T-Short Products (such as APIs and Self-Serve Advertising Interfaces) for creation, submission and/or presentation of any advertising or other commercial or sponsored activities or content (collectively, "Self-Serve Advertising Interfaces") and any orders that you place through the Self-Serve Advertising Interfaces ("Order").

You can target a desired audience by purchasing ads to be displayed on T-Short.
When you place an Order, you inform us of the type of advertising you want to purchase, the amount you want to spend and your bid. If we accept your Order, we will display your ad as soon as the advertising resource becomes available. We do our best to show your advertisement to the target audience or to achieve the desired outcome, but we cannot guarantee in every instance that your advertisement will reach that audience or outcome.

Your advertisements must comply with all applicable laws, rules and regulations as well as our Advertising Policies. Non-compliance may result in various consequences, including cancellation of your advertisements and account termination.

We can reject or remove any advertisement for any reason.

When paying for your Orders, you must comply with the following requirements:

a) You must comply with the Community Payment Terms to the extent applicable.

b) You must pay all amounts specified in each Order you place, along with all applicable taxes. The amount you owe for each Order will be calculated based on our tracking mechanisms.

c) By placing an Order, you authorize us to obtain your and/or your company's credit report from the credit bureau at the time you place the Order or later.

d) You are responsible for maintaining the security of your advertising account, and you understand that you will be charged for any Orders placed on or through this account.

e) If you are making direct debit payments, you agree that we can charge you any amount within the limit that was agreed upon with you when you signed up. We will notify you in advance if any debit exceeds the agreed limit.

f) You can cancel your Order at any time, but your advertisements may be demonstrated for up to 24 hours after the notice of cancellation, and you will be still responsible to pay for all advertisements that were shown.

g) The amounts we charge you may be subject to and include applicable taxes and fees, including without limitation withholding taxes. You must pay and remit all taxes that apply to your transactions. You agree to indemnify and hold us harmless from and against any claims arising out of your non-compliance with the foregoing obligation.

h) If we are unable to charge you using the specified payment method or if your account is past due, we will take additional steps to collect the past due amount. You will pay all costs associated with the collection, including our reasonable legal fees. Past due amounts will accrue interest at 1% per month or the lawful maximum, whichever is less.

i) We may allow you to pay for advertising with an "Advertiser Balance". This is a prepaid balance that can only be used to purchase advertising on T-Short. Advertiser Balances are only for business and commercial purposes. Advertiser balances are non-refundable except where required by law. T-Short is not a bank and does not provide banking services, so Advertiser Balances do not earn interest, are not subject to deposit obligations, and are not insured by the Federal Deposit Insurance Corporation, the Financial Services Compensation Scheme, or any other public or private organization or insurance program.

j) Depending on your payment method, we categorize you into one of two categories: invoiced and non-invoiced customers. Invoiced customers are customers for whom T-Short sets a maximum spending limit and issues invoices on a periodic basis in accordance with the applicable invoicing terms. Non-invoiced customers are those who must make payment at the time of purchase. In its sole discretion T-Short may decide whether to classify you as a non-invoiced customer based on your advertising costs and creditworthiness.

From time to time, we need to test improvements of our audiences and delivery systems which could affect your advertising. This testing is conducted in order to improve the effectiveness of your advertising. We reserve the right to conduct testing when we deem it will be beneficial for advertiser performance.

We will determine the size, placement and positioning of your advertisement.
The advertising schedule depends on resource availability. It may contain breaks.
We do not guarantee the reach or effectiveness of your ads, for example, the number of people who will see your ad or the number of clicks your ad will receive.

We cannot control how clicks are generated on your advertisements. We use some systems to detect and filter click activity, but we are not responsible for click fraud, technical failures or other activities that result in invalid clicks, which may affect the cost of advertising.

Our license to deliver your advertisement will end when we have completed your Order. However, you understand that:

Once displayed, the advertisement is public information. People beyond your target audience can access and share your ads. If users have interacted with your ads, your ads may remain as our Products (for example, it may be shared by people until users delete this ad or can be visible to users through their account tools).

You consent that T-Short may disclose your advertising content and all information related to your advertising campaign to any government authority or agency if it believes that disclosure would assist in a legal investigation.
You must not issue any press releases or make any public statements about your relationship with T-Short without our prior written permission.

If you are advertising on behalf of another person, you must have permission to place such advertising and you agree as follows:

You represent and warrant that you have the authority to bind and will bind the advertiser to comply with these Self-Serve Advertising Terms or the User Agreement, to which you also agree.

If the advertiser you represent violates these Self-Serve Advertising Terms or the User Agreement, we may hold you responsible for such violation.

You agree that we may provide reporting on the campaign to the end advertiser on behalf of whom you placed it.

We may ask you to review and accept additional terms that relate to your use of a specific feature or functionality provided within the Self-Serve Advertising Interfaces. If these additional terms conflict with these Self-Serve Advertising Terms, the additional terms related to your use of the specific feature or functionality will take precedence. We may modify or update these Self-Serve Advertising Terms from time to time. By continuing to use the Self-Serve Advertising Interfaces, you accept such changes.


Pages, Groups and Events Policies.
This guide applies if you create or administer a page, group, or event on T-Short.

1. Since T-Short is a thematic network only for professionals and animation fans, all Groups, or Pages, or Events created on the Site must correspond to the Site's theme.

2. Pages, or Groups, or Events not related to the T-Short platform, such as a Sponsor Page, Major Advertiser Page, etc., may be created only with the written permission of the Administration and at the discretion of the T-Short Administration.

3. The following Terms, our Data Policy and User Agreement apply to all creators and administrators of Pages, Groups, and Events on T-Short. You are responsible for ensuring that your Page, Group, or Event complies with all applicable laws, rules, and regulations:

a) Pages, Groups and Events must not promote products, services, schemes or offers involving deceptive or misleading business practices, in particular to obtain money or personal information by fraudulent means.

b) Pages, Groups or Events must not impersonate official Pages, Groups or Events of a brand, facility or public figure, or their representatives if they are not. If a Page, Group or Event is used to express support for or interest in a brand, facility or public figure, its name or description must clearly indicate that it is not an official representation.

c) Pages, Groups, and Events must not promote or host online gambling, online real money games, or online lotteries without our prior written permission.

d) Pages, Groups, and Events must not encourage people to misuse T-Short features or functions.

e) Pages, groups and events must not promote alcohol treatment centers that mislead patients, use treatments that are harmful to their health, or otherwise violate applicable law.

f) If you use T-Short to announce a promotion or run a promotion (such as a contest or sweepstakes), you are responsible for the legality of such promotion.

g) T-Short does not assist you in running promotions, and if you use our service for your promotions, you do it at your own risk.

h) If you receive content and information directly from users, your Page, Group or Event must provide clarification that you, and not T-Short, are collecting this information, must provide notice and obtain user consent for your use of the information and content that you are collecting. Regardless of how you obtain content and information from users, you are responsible for obtaining all necessary permissions from them for any use of that content and information for other purposes.

i) Your Page, Group, or Event must not collect user content or information or otherwise access T-Short using automated means (such as harvesting bots, robot software, spiders or scrapers) without written permission from T-Short.

j) Your Page, Group, or Event must not use information obtained as a result of a person's interaction with your Page's call-to-action button for any purpose other than to provide the service associated with such call-to-action button. If you wish to use such information for any other purpose, you must first obtain that person's explicit consent.

k) If you are in the EEA, data processing for Page Statistics may be governed by the Page Insights Controller Addendum, which is part of this Pages, Groups, and Events Policy.

4. Special terms for Pages

a) Page names must not contain profanity, grammatical errors, unnecessary punctuation. They must not consist only of generic terms or location names.

b) Content posted on the Page is available to anyone who can see the Page.

c) Your Page cover photo and profile picture must not contain verified icons (checkmarks) or third-party products, brands, or sponsors.

d) When sharing third-party links from your Page, you must not edit any elements of the post preview.

e) You must not abuse the T-Short upload functionality in connection with your Page.

f) Name changes and mergers must not create a false impression or unintended association, and must not significantly change the subject matter of the Page.

g) You must not accept any fees to drive traffic to an app or site used for traffic arbitrage or which contain too many ads compared to the amount of useful content, or content that is extremely sexual or shocking, clickbaits, or content that promotes scams.

h) You must not post or provide content on the pages with a minimal originality.

i) Your Page must contain all necessary disclosures to T-Short users, such as a warning about the commercial nature of the content posted by you.

5. The following Job Posting Policy describes the types of job postings that are allowed on T-Short. These Terms apply to all job postings on the Pages and Groups. Job postings must comply with our Community Policies as well as the Job Posting Policy.

a) Job postings must not promote employment opportunities that are fraudulent, misleading or fake.

b) Job postings must not promote employment opportunities related to illegal activities, goods or services.

c) Job postings must not unlawfully discriminate against applicants based on any protected characteristic, including, but not limited to, race, ethnicity, color, national origin, religion, age, sex, sexual orientation, gender identity, marital status, disability, medical condition or genetic disease or other characteristic protected by federal, state or local law. Job postings must comply with all applicable anti-discrimination laws.

d) Job postings must not promote employment opportunities with erotic connotations.

e) Job postings must not promote employment opportunities that require adult services or goods.

f) It is prohibited to ask candidates for identification or any financial information in job postings.

g) Job postings must accurately and fully describe the product or business model being promoted. Job postings must not promote opportunities for participation in business models that promise quick rewards for little cost, including multi-level marketing schemes.

h) Job postings must not impersonate a brand, company, legal entity or public figure. In addition, false information about a partnership with any company is prohibited.

i) Job postings should not promote employment opportunities related to illegal activities, goods or services, or psychoactive substances.

j) Job postings must not contain profanity or grammatical or punctuation errors. Symbols, numbers and letters must be used properly without intention to mislead us or other control systems during advertisement review process.

6. Special terms for Events

a) Events must not use automated means to create invitations to events.

b) Events must clearly and conspicuously provide advance notice of any activities and additional fees associated with the purchase of an event ticket.

c) Changes to events must not result in misleading or unintended connections and must not significantly change the events.


Community Payments Terms.
If you are under eighteen (18) years of age, you may use the payment features of T-Short Products only under supervision of your parent or guardian. Make sure that you and your parent or guardian have read the Payment Terms and understand your rights and obligations.

We do not accept any payments directly via our Site, but you can top up your virtual wallet or make any other payments via trusted payment systems, such as PayPal.

Music Guidelines. These supplemental terms apply if you post or share any videos or other content containing music on any T-Short Products.

You are responsible for the content you post

People use our Products to share content with their family and friends. Keep in mind you remain solely responsible for the content that you post, including any music that features in that content. Nothing in these terms constitutes any authorization by us with respect to any use of music on any of our Products.

Use of music for commercial or non-personal purposes in particular is prohibited unless you have obtained appropriate licenses.

You may not use videos on our Products to create a music listening experience

We want you to be able to enjoy videos posted by family and friends. However, if you use videos on our Products to create a music listening experience for yourself or for others, your videos will be blocked and your page, profile or group may be deleted. This includes Live.

Unauthorized content may be removed

If you post content that contains music owned by someone else, your content may be blocked, or may be reviewed by the applicable rights owner and removed if your use of that music is not properly authorized.

You may not be able to post or access videos containing music in every country of the world

We want you to be able to share videos with your family and friends wherever they are, but any music in your video, if it is allowed at all, may not be available in all countries of the world.

By registering, the User agrees to these Terms and accepts the rights and obligations associated with the use and operation of the Site as specified in these Terms.


The Network Enforcement Act, ("NetzDG")

NetzDG is a German law that requires social networks to apply a procedure for handling complaints about illegal content. The full text of NetzDG can be found here. The Federal Office of Justice has published frequently asked questions about the law, which can be found here.

If you believe the content is illegal, please submit a complaint to NetzDG through the site's contact form.

Law enforcement officials can request information in accordance with NetzDG through the website contact form.
